MISSING MODS – PURCHASE OPTIONS CANCELLATION POLICY

This Purchase Options Cancellation Policy explains when an order placed with Missing Mods may be cancelled and how cancellation rights apply to standard purchases, pre-orders, made-to-order products and customised products.

Nothing in this policy affects any statutory consumer rights that cannot legally be excluded.

1. Cancelling a Standard Online Order

Consumers purchasing goods online may have a statutory right to cancel an order within 14 days of receiving the goods, even where the goods are not faulty.

Where this right applies, you must notify Missing Mods of your decision to cancel within the applicable cancellation period.

Please include your:

name;
order number; and
details of the item or items you wish to cancel.

Where goods have already been dispatched or received, they must be returned in accordance with our Returns & Refund Policy and applicable consumer law.

2. Cancelling Before Dispatch

If you wish to cancel an order before it has been dispatched, please contact us as soon as possible.

We will make reasonable efforts to stop the order before fulfilment.

However, we cannot guarantee that an order can be stopped once processing, production, packing or dispatch has begun.

Any cancellation and refund will be dealt with in accordance with applicable law and the circumstances of the order.

3. Pre-Order Cancellations

Pre-order products are products that are not available for immediate dispatch.

Any estimated pre-order dispatch date shown on the website is an estimate and may change due to:

manufacturing delays;
supplier delays;
shipping delays;
product availability; or
circumstances outside our reasonable control.

If a significant delay occurs, Missing Mods will make reasonable efforts to contact affected customers.

Where applicable law gives you a right to cancel because of a significant delay or failure to supply the product, nothing in this policy limits that right.

4. Made-to-Order Products

Many Missing Mods products may be manufactured after an order has been placed.

The fact that a product is made to order does not automatically remove statutory cancellation rights.

Unless a product is genuinely personalised, customised or manufactured specifically to an individual customer's requirements, any applicable statutory cancellation rights will continue to apply.

5. Customised, Personalised and Bespoke Products

Some products may be genuinely:

personalised;
customised;
made specifically to your individual specification; or
otherwise bespoke.

Where a product falls within an applicable statutory exception for customised or personalised goods, change-of-mind cancellation rights may not apply.

Where appropriate, this will be identified in the relevant product information.

If you are unsure whether a product is considered customised or bespoke, please contact Missing Mods before ordering.

This does not affect your statutory rights where a customised or bespoke product is faulty, damaged, defective or not as described.

6. Production Already Started

For products manufactured after an order is placed, production may begin shortly after your order is accepted.

Starting production does not by itself remove any statutory cancellation rights that apply.

However, where a product has been genuinely customised or manufactured specifically to your individual specifications, different cancellation rules may apply.

7. Orders Cancelled by Missing Mods

Missing Mods may cancel or refuse an order where we reasonably believe that completing the order could:

breach applicable law;
breach import or export restrictions;
breach delivery restrictions;
create an unreasonable legal or regulatory risk;
create an unreasonable safety risk; or
otherwise be unlawful to fulfil.

Where an order is cancelled by Missing Mods before fulfilment, any payment received for that order will normally be refunded.

8. Product Availability

Where an order cannot be fulfilled because a product is unavailable, Missing Mods may contact you regarding the order.

Where the order is cancelled because the product cannot be supplied, any payment received for the cancelled item will normally be refunded in accordance with applicable law.

9. Cancellation Due to Pricing Errors

Missing Mods reserves the right to correct genuine pricing errors.

If an obvious pricing error has occurred, we may contact you before fulfilling the order and give you the option to:

continue with the order at the correct price; or
cancel the order and receive a refund.

10. Returning Goods After Cancellation

Where a statutory cancellation right applies and you have already received the goods, they should be returned with reasonable care.

You may inspect and handle the goods only to the extent reasonably necessary to establish their:

nature;
characteristics; and
functionality.

Where permitted by law, Missing Mods may make an appropriate deduction from a refund where the value of the goods has been reduced because they have been handled beyond what would reasonably be permitted when inspecting goods in a shop.

Customers are generally responsible for the direct cost of returning goods when exercising a statutory change-of-mind cancellation right.

11. Refunds Following Cancellation

Where a refund is legally due, Missing Mods will process it in accordance with applicable law.

Where a statutory cancellation right applies, the applicable refund will normally include the cost of standard delivery, subject to the rules applying to the particular order.

If a more expensive delivery service was selected instead of our least expensive standard delivery option, any refund of delivery charges may be limited to the cost of the least expensive standard delivery option where permitted by law.
